1 – Falta de Políticas Legales Transparentes
La Ley de Servicios de la Sociedad de la Información y de Comercio Electrónico (LSSICE) y la Ley de Protección de datos Personales y Garantía de los derechos digitales establecen la obligación de contar con textos legales claros y transparentes para los consumidores.
Los comercios deben identificarse, contar con una política de privacidad, aviso legal y política de cookies, y unos términos y condiciones de contratación acordes a la normativa vigente.
2 – No tener en cuenta la Propiedad Intelectual
Usar imágenes, textos u otros contenidos protegidos por derechos de autor sin autorización es ilegal, lo que puede dar lugar a reclamaciones por infracción de derechos de autor. Se debe utilizar contenido con licencia o obtener la autorización del autor, y en el caso de crear contenido propio, debe considerarse la opción de registrar tus propiedad intelectual
3 – Desconocimiento de las Leyes Fiscales
La regulación en materia fiscal puede ser complicada en el sector de los e-commerce, especialmente en comercios que operan a nivel internacional. Resulta imprescindible contar con un correcto asesoramiento fiscal para cumplir con todas las obligaciones legales y fiscales que se imponen a estos comercios.
4 – No cumplir con la Legislación Europea
La Plataforma ODR (Online Dispute Resolution) para la resolución extrajudicial de litigios on line entre consumidores y comerciantes, es una gran desconocida que puede provocar una sanción al titular del comercio.
El Reglamento (UE) 524/2013 obliga a los comerciantes a ofrecer a los usuarios la posibilidad de acudir a esta plataforma europea, donde de forma gratuita y electrónica, las empresas y consumidores tratan de resolver la incidencia en un plazo general de 90 días.
5 – Posibles Sanciones
La importancia de estar al corriente de tus obligaciones legales puede medirse por las sanciones que llevan aparejadas su incumplimiento, y es que no hablamos de multas insignificantes. La Ley de Servicios de la Sociedad de la Información y el Comercio Electrónico (LSSICE) puede sancionar con multas que van desde los 600 hasta los 600.000 euros.
Y no solo eso, las infracciones en materia de protección de datos también pueden ser sancionadas, siendo cuantificadas económicamente atendiendo a cada caso individual y teniendo en cuenta lo recogido en el art. 83.2 del RGPD.
